Work Visa (H-1B Visa)

This visa category applies to people who wish to perform services in a specialty occupation, services of exceptional merit and ability relating to a Department of Defense (DOD) cooperative research and development project, or services as a fashion model of distinguished merit or ability. In order to qualify, the employer must receive certification from the Department of Labor that they will pay a wage and provide working conditions similar to that of an American worker. In the case of a specialty worker, the employer must also show that the work is complex enough to require a bachelor’s degree or foreign equivalent. In the case of a DOD worker, the job must arise from an agreement between the DOD and the alien’s home government. In the case of a fashion model, the model must be of some distinguished merit and ability. Finally, H-1B visa holders can apply for their spouses and children as well.
