Temporary Protected Status (TPS)

TPS grants the safe haven in the U.S. to a foreign national. The Attorney General may designate TPS for nationals of any country which is experiencing ongoing arms conflict posing serious threat to the personal safety or environmental disaster resulting in substantial but temporally disruption of living conditions or extraordinary and temporary conditions that prevent nationals from returning in safety. TPS is granted to individuals who are already in the U.S. and there are many countries which have been granted TPS from time to time. TPS is granted to an individual if he/she belongs to a country that is designated as a TPS country by the U.S. and has been continuously present in the U.S. since the effective date of the most recent designation and has been continuously residing in the U.S. since the date set by the Attorney General. Is otherwise, admissible as an immigrant, has not been convicted of a felony, two or more misdemeanors in the U.S. and does not fall within one of the mandatory bars to withholding or removal and timely files for the TPS. TPS applicant is given a work permit and also given advance parole to travel.
